5 Acceptable Short Sale Hardships
Has the Regatta Real Estate market changed so much that you are now upside down on your Home, Condo or Land?
It has for a lot of people in Regatta Bay and many of these folks are turning to short sales to get out from underneath the mounting financial pressure.
What is a short sale?
Simply stated a short sale is when you sell for less than what is owed on the mortgage and the bank accepts the amount.
Why would the bank do this?
Well let’s say your financial picture has changed since you bought the property and you are now facing a “financial hardship” that has put you in a position of not being able to make your payments and the possibility of foreclosure is looming. In cases where foreclosure is likely it makes sense for the bank to negotiate a short sale because it is generally costs the bank much less than if they have to take the property back, maintain it while marketing it to a new buyer – all with the possibility of getting less than what was on the table as a short sale.
What are acceptable hardships?
According to HUD – the Dept. of Housing and Urban Development – there are many valid reasons and hardships to be acceptable for default. Here are 5 of them.
- Death of Principal Borrower
- Serious Illness of Principle Borrower
- Marital Problems (Divorce, Separation)
- Unemployment
- Lessened Income

Rental Income From Real Property to file 1099s with the IRS
Small Business Jobs Act enacts new provision: 1099s will be required for 2011 payments
The recently enacted Small Business Jobs Act includes a provision related to reporting requirements of rental property expense payments. After Dec. 31, 2010, the new law requires those who receive rental income from real property to file 1099s with the IRS for service providers such as plumbers, painters and accountants, who receive more than $600 in payments over the course of the year. Even though the 1099 forms will not need to be issued until early in 2012, it will be necessary to begin keeping track of payment information on Jan. 1, 2011, and to collect completed w-9 forms from service providers to obtain their names, addresses and taxpayer identification numbers. Exceptions are provided for individuals renting their principal residences (including active members of the military), taxpayers whose rental income doesn’t exceed an IRS-determined minimal amount, and those for whom the reporting requirement would create a hardship (under IRS regulations).
Included in the provision is an increase in penalties for failure to file 1099s with the IRS. For further information, contact your tax accountant
